Sandusky's lawyer expects more charges

The preliminary hearing of accused child molester Jerry Sandusky was pushed back Tuesday, while his attorney expressed concern about possible new charges and jail time for the former Penn State assistant coach.

Sandusky, who is charged in a 40-count indictment of sexually assaulting eight boys over a period of 15 years, will appear in court Dec. 13.

The 67-year-old former Penn State defensive coordinator was initially scheduled to appear before a judge Nov. 9, but that was moved to Dec. 7 earlier this month.

News of the delay came as Sandusky's attorney Joseph Amendola admitted to ABC News on Tuesday that he anticipated more charges to be filed against his client in December, which could lead to jail time, pending a full trial.

"My concern is if they bring new charges based upon new people coming forth, that bail's going to be set, and he's going to wind up in jail," Amendola told ABC.

A new out-of-county judge was appointed to oversee the case last week after concerns were raised about District Judge Leslie Dutchcot's former ties with The Second Mile — the nonprofit organization founded by Sandusky at the center of the scandal.

Dutchcot, who released Sandusky on $100,000 unsecured bail, came under criticism after it was revealed she had been the beneficiary of a fundraiser hosted by Second Mile in 2007 while she was running for office.

Prosecutors had requested bail be set at $500,000 and that an ankle monitor be required as a condition for Sandusky's release.

Senior Judge Robert E. Scott was named as Dutchcot's replacement in response to a request from the Centre County Common Pleas Court.

Former Penn State athletic director Tim Curley and vice president Gary Schultz — both charged with perjury and failure to report suspected child abuse — are scheduled to appear for a preliminary hearing Dec. 6.
