Fantasy Games Supplemental Terms of Use

ACCEPTANCE OF TERMS

Welcome to FOXSports.com Fantasy Games ('Fantasy Games'), owned and operated by FOX Sports Interactive Media, LLC ('FSIM'). FSIM offers the Fantasy Games service to you, subject to (i) these Additional Terms, which supplement the FSIM Terms of Use, located at http://msn.foxsports.com/name/Legal/termsOfUse, which are hereby incorporated by reference, and (ii) the game instructions for the applicable Fantasy Game, each of which can be accessed through the Fantasy Games homepage at: http://msn.foxsports.com/fantasy) and are hereby incorporated by reference (collectively, the 'Agreement'). ANY PARTICIPATION IN FANTASY GAMES WILL CONSTITUTE ACCEPTANCE OF THIS AGREEMENT. IF YOU DO NOT AGREE TO ABIDE BY THE AGREEMENT, PLEASE DO NOT PARTICIPATE IN FANTASY GAMES. FSIM may modify the Agreement from time to time and such modification will be effective upon posting. YOU AGREE TO BE BOUND TO ANY CHANGES TO THIS AGREEMENT WHEN YOU USE THE FANTASY GAMES SERVICE AFTER ANY SUCH MODIFICATION IS POSTED. IT IS THEREFORE IMPORTANT FOR YOU TO REVIEW THIS AGREEMENT REGULARLY TO ENSURE YOU ARE UPDATED ON ANY CHANGES.

COLLECTION OF PERSONAL INFORMATION

By signing up for Fantasy Games, you agree to FSIM's use of your personal information as described in FSIM's Privacy Policy (http://msn.foxsports.com/name/Legal/privacyPolicy). Additionally, you agree to allow FOXSports.com to display your full (first and last) name as provided during registration for your FOXSports.com account to all members of the fantasy leagues in which you participate (the 'League'), on all message boards and leaderboards contained in the League and on any other Fantasy Game pages related to the League.

FOXSPORTS.COM ACCOUNT REQUIREMENT

To participate in Fantasy Games, you must have a valid FOXSports.com account. If you do not have an account, you will be prompted to sign up for one before completing the registration process for Fantasy Games.

TERMINATION OR MODIFICATION OF YOUR ACCOUNT

FSIM expressly reserves the right to immediately modify, suspend or terminate your account and refuse current or future use of any FSIM service, including the Fantasy Games service, if FSIM, in its sole discretion: (a) believes you have violated or tried to violate the rights of others; (b) becomes aware of information indicating a safety concern for you, other FSIM users, or the general public; (c) it appears you have engaged in cheating or manipulation of Fantasy Games; or (d) FSIM otherwise believes you have acted in a manner inconsistent with the spirit or the letter of the Agreement. In addition, FSIM may, but has no duty to, immediately terminate your Fantasy Games account, and refuse current or future use of any FSIM service, if, in its sole opinion, it concludes that you have provided false information in connection with your registration data. If your Fantasy Games account is suspended or cancelled for any of these reasons, all information contained within it may immediately be deleted or made inaccessible. FSIM accepts no liability for information that is deleted or inaccessible due to the termination of your account.

ACCURACY OF INFORMATION

ALL STATISTICS AND OTHER INFORMATION PROVIDED THROUGH FANTASY GAMES ARE UNOFFICIAL. Fantasy Games and their respective components are offered for informational and/or entertainment purposes only. While FSIM and the third parties used to provide the Fantasy Games service (the 'Third Party Providers') use reasonable efforts to include accurate and up-to-date information, neither FSIM nor its Third Party Providers warrants or makes any representations of any kind with respect to the information provided to you through the Fantasy Games service. FSIM and its Third Party Providers shall not be responsible or liable for the accuracy, usefulness or availability of any information transmitted or made available via the Fantasy Games service, and shall not be responsible or liable for any error or omissions in that information.

ENTERTAINMENT PURPOSES ONLY

Fantasy Games is to be used for entertainment purposes only and may not be used in connection with any form of gambling or wagering.

DISCONTINUANCE OF THE FANTASY GAMES SERVICE

FOXSports.com Fantasy Games and its related benefits are offered at the discretion of FSIM, and FSIM has the right to modify or discontinue, temporarily or permanently, the Fantasy Games service in whole or in part for any reason, with or without notice to you. You agree that FSIM will not be liable to you or to any third party for any modifications or discontinuance of the Fantasy Games service.

WHAT TO DO IF YOU WITNESS A VIOLATION

If you witness any user activity in FOXSports.com Fantasy Games that violates any part of the Agreement then in effect, please notify us of the activity via the feedback form located at http://msn.foxsports.com/feedback. FSIM cannot guarantee that any action will be taken as a result of your notification, but we appreciate your help in making the service a fun place for everyone.

PRIVATE GROUP RULES

Certain "private groups" or "private leagues" (collectively referred to herein as "Private Groups") are created to the specifications implemented by the creators other than FSIM. These Private Group creators and owners of entries in the Private Group are responsible for handling all conduct, communication, and fair play issues that arise in their Private Groups. Fox Sports is not responsible or liable for handling any conduct or communication problems that may take place in these Private Groups.
