Former NBA All-Star Joe Barry Carroll is suing an Atlanta restaurant for discrimination, claiming he was asked to give up his seat for two white women because he is black, The Atlanta Journal-Constitution reported Monday.

The restaurant contends the two were asked to relinquish their seats as part of the long standing practice of asking men to forfeit seats to female patrons.
Carroll and Shaw were seated at the popular Atlanta restaurant's bar enjoying drinks and appetizers when two women approached the bar, prompting restaurant management to ask the men to give up their seats. The two refused, which led to management calling an off-duty police officer, who provided security and had the two men escorted out.
Jury selection was completed earlier Monday, with opening arguments scheduled to begin in the afternoon, according to The Journal-Constitution.
US Magistrate Janet King ruled in 2010 there was no direct evidence of racial discrimination, but said enough circumstantial evidence existed to permit a jury trial.
According to the paper, King's decision to move for a jury trial stemmed from testimony by a former restaurant employee who said she was told by management that the desired clientele for the bar were white businessmen and buxom, blonde women.
Carroll, 53, spent 10 years in the NBA after being selected with the first overall pick in the 1980 draft. The former Purdue standout played center for the Golden State Warriors, Houston Rockets, New Jersey Nets, Denver Nuggets and Phoenix Suns. He retired from basketball in 1991.
